All notices under this agreement are considered delivered and accepted once electronically confirmed.
2. Service Usage Policy
You agree to comply with all applicable local, national, and international laws and regulations. You are solely responsible for any activities conducted through your account, including the content of messages sent using our services.
Strictly Prohibited Activities
You agree not to use the service to:
- Promote alcohol, gambling, or dating
- Send unsolicited messages (spam)
- Collect info without consent
- Transmit malware or viruses
- Infringe on intellectual property
- Mislead or impersonate others
- Deceptive or fraudulent offers
- Sexual or offensive content
3. Delivery & Credits
Operator Dependencies
You acknowledge that SMS delivery relies on telecom operators and is subject to their technical constraints. Successful delivery depends on factors including the recipient's network coverage, phone status, and memory availability.
Infozy SMS does not guarantee the availability, performance, or error-free operation of the service. We make every effort to deliver messages promptly, but credits are not refundable for undelivered messages.
Credits in your SMS account do not accrue interest and must be used within the validity period specified at purchase. Remaining account balances will be refunded only if applicable under our no-refund policy.
4. Limitation of Liability
"The service is provided 'as is' and 'as available', without warranties of any kind. Your use of the service and the internet is at your own risk."
We are not liable for:
- • Errors, omissions, or losses by delays
- • Consequential damages from use
- • Failed delivery due to network factors
Data Security:
SMS messages are transmitted unencrypted and may be intercepted. We recommend using multiple channels for sensitive info.
5. Modification of Terms
Infozy SMS reserves the right to update or change these terms at any time as necessary to improve or maintain the service. You are responsible for reviewing these terms regularly.
If any specific terms conflict with these general terms, the specific terms shall apply.
6. Termination
If you breach these terms, we reserve the right to suspend or terminate your account and recover any damages. Suspension does not release you from obligations already accrued.
You may also terminate this agreement at any time by sending us written notice via email. Upon termination, you will lose access to any remaining credits.
7. Regulatory Compliance
These terms and conditions are subject to change in accordance with TRAI (Telecom Regulatory Authority of India) rules and regulations.
